If you live in Spain or married here, you can usually divorce in Spain even as a foreign national — and getting the process and the paperwork right protects your children, your finances and your peace of mind. At FRB Abogados, with more than 40 years in family law, we advise international couples in English, from an amicable agreement to a fully contested case.
Can you divorce in Spain?
In most cases yes: Spanish courts have jurisdiction when the couple live here or have sufficient connection to Spain, under the applicable EU rules. In an international marriage the first questions are where to divorce and which country’s law applies to your divorce and to your assets — decisions that can change the outcome significantly. We advise you on this before starting [please verify the rules for your situation].
Mutual agreement or contested
Mutual-agreement divorce
When both spouses agree, we draft the settlement (convenio regulador) covering:
- The children
- Maintenance
- The division of assets
This route is faster, cheaper and less stressful. You can divorce once three months have passed since the marriage, without having to allege any cause.
Divorce before a notary
Where there are no minor or dependent children, the divorce can be finalised before a notary by public deed, with a lawyer — often the quickest route.
Contested divorce
When there is no agreement, the court decides on custody, maintenance and the family home after a demand, defence and hearing.
Children: custody, contact and relocation
We handle custody (shared or sole) and the contact schedule, always guided by the best interests of the child, and we deal with the sensitive question of relocation — when one parent wants to move, within Spain or abroad, with the children.
Maintenance and finances
We calculate and claim child maintenance in proportion to income and needs, and advise on spousal maintenance where the divorce leaves one spouse worse off. Where maintenance goes unpaid, we enforce it.
The family home and dividing your assets
We resolve who uses the family home and how the matrimonial property is divided, which depends on your economic regime (community property or separation of assets) and on where your assets are located — a key issue when you own property in more than one country.
